Types of Powers of Attorney

A power of attorney is a legal document which enables you to appoint someone to act in your behalf in the event you become physically or mentally incapacitated. The person who creates the power of attorney is called the “principal”, while the person who is given authority to make decisions on the principal’s behalf is the “agent” or “attorney-in-fact.” Keep in mind, the attorney-in-fact does not have to be an actual lawyer.

  • Non-durable power of attorney – Only used for a brief period of time and often for a specific transaction. If the principal becomes incapacitated during this period or once the transaction is complete, this type of power of attorney ends.
  • Durable power of attorney – Considered much broader than the non-durable power of attorney, an agent or attorney-in-fact is authorized to manage all of the principal’s affairs if they become incapacitated or unable to make sound decisions. Once the principal passes away, the durable power of attorney expires.
  • A limited or special power of attorney – This type of power of attorney is only used for a one-time transaction, such as the sale of a home or a financial transaction. In most cases, the principal cannot complete the transaction due to illness or a prior commitment, authorizing the agent to decide on their behalf.
  • Financial power of attorney – The agent has the authority to make financial decisions and transactions on the principal’s behalf. The amount of control an agent has can either be limited in scope or general.
  • Medical power of attorney – The agent has the authority to make health care decisions on the principal’s behalf.
  • Springing power of attorney – This type of power of attorney takes effect at a future date and only when certain events happen, such as when the principal becomes incapacitated or is out of the country and not able to handle certain affairs.
